The 2 documents above are the 1st sheet of our Lawsuit against the Vimercati's. We were awarded judgment at the District Justice Hearing in October of 2002. Vimercati's appealed and after numerous postponements by the Vimercati's, had our

arbitration hearing at the Quinn Law Firm in Erie, Pa. on January 29th, 2004. Crosswinds Stable was also awarded judgment against the Vimercati's on 2/5/04. Copy of judgment award above.

In November of 2002 Vimercati's purchased 2 horses from me with the stipulation that they would remain here for a few weeks. Her exact statement was "Due to weather constraints, I don't know how soon I can get a hauler there. Would it be all right if they stayed for a few weeks?" After keeping the horses free of charge for 6 weeks, all while I continue to ask when she is shipping them and who is hauling them, and Xena keeps telling me she's working on the shipment arrangements, Xena states that she is getting married and can't afford to ship them. She is 4 weeks from her wedding and she has all the wedding expenses as well as advertising her stallions for breeding for the 2003 season. In other words, everything comes before her responsibility to ship these horses. I informed her that I would be charging board after Jan. 15, 2003. I was then told that I had no legal rights. She would not pay me anything for board, and told me at one point that if I didn't quit beating a dead horse, she would leave them here longer. Wrong thing to tell me. So now we've been to court 3 times. On 6/29/2005, I received the final ruling from the court. I was awarded judgment for the third time. Xena's counterclaim was dismissed with a zero award to her.

I figured conservatively that Xena spent between $16,000 and $20,000 in legal fees, and expenses. You see she had dreams of collecting upwards of $30,000 on her countersuit, which had no merit.
